Document Proving Diagnosis


You may send us a copy of the Tobacco Victim’s diagnosis of Lung Cancer, Throat Cancer, or Emphysema or COPD (GOLD Grade III or IV) between March 8, 2015 and March 8, 2019, inclusive of those dates. The Diagnosis may be proven through:

  • A copy of a pathology report confirming diagnosis of Lung Cancer or Throat Cancer, as applicable, between March 8, 2015 and March 8, 2019 (inclusive of those dates);
  • A copy of a report of a spirometry test performed between March 8, 2015 and March 8, 2019 (inclusive of those dates), that first demonstrated a FEV1 (non-reversible) of less than 50% of the predicted value to first establish a diagnosis of Emphysema or COPD (GOLD Grade III or IV);
  • A copy of an extract from the Tobacco Victim’s medical file confirming the diagnosis of Lung Cancer, Throat Cancer or Emphysema or COPD (GOLD Grade III or IV) between March 8, 2015 and March 8, 2019 (inclusive of those dates);
  • A completed Physician Form; or
  • A written statement from the Tobacco Victim’s Physician, or another physician having access to the Tobacco Victim’s medical record, confirming the diagnosis of Lung Cancer or Throat Cancer between March 8, 2015 and March 8, 2019 (inclusive of those dates) and providing at least one of the following records to verify the diagnosis and date of diagnosis:
    • pathology report, operative report, biopsy report, MRI report, CT scan report, PET scan report, x-ray report and/or sputum cytology report.

Please note that these documents will not be analyzed at this time.

Documents for Legal Representatives


You may send us any documents you already have in your possession related to your representation of an estate or living PCC-Claimant. Here are examples of the types of documents you can send us, if applicable:

  • Copy of the death certificate;
  • Grant of Probate (if there is a Will);
  • Grant of Administration (if there is no Will);
  • Power of Attorney;
  • Proof of Guardianship;
  • Document showing that the Public Guardian and Trustee has been appointed as the trustee for the PCC-Claimant; or
  • Any other document which establishes your authority to act, depending on the province or territory.

Further details and specific document requirements will be outlined in the Claim Forms, which will be posted to this website once the claims process begins.

In certain situations, additional documents may be required to support a claim as a Legal Representative of a PCC-Claimant or Estate of a PCC-Claimant. If we determine that more documents are needed, we will contact you.

Proof of Cigarette Consumption


Please do not send us invoices for cigarette purchases or photos of cigarettes or someone smoking. This type of evidence is not required. We will delete any such documents received.

You will be able to prove the date you started smoking and the number of cigarettes you smoked through a sworn declaration, stating that the information you have provided in the Claim Form is true.

During the claims process, we’ll have Commissioners of Oaths who can assist you to swear the declaration in the Claim Form.
